These terms govern the services provided by Nimble Dingo (ABN 13934722172). By submitting an enquiry, signing up for a free website, or paying for hosting, you agree to these terms.
1. Free Website Build
The website build itself is provided at no upfront cost. The client pays a monthly hosting fee to keep the website live and maintained. Build typically takes 5–10 working days from when all required information is provided.
2. Monthly Hosting Fee
The hosting fee is AU$38.99 per month for Australian clients, or £19.99 per month for UK clients. This covers hosting, security, technical maintenance, and small content updates as outlined in section 7.
3. Cancellation
The service is month-to-month with no minimum term. Cancellation can be requested at any time. The website will remain live until the end of the current billing period, after which it will be taken offline.
4. Domains
If the client does not already have a domain name, one can be registered as an optional paid service. Any purchased domain remains the property of the client.
5. Logos
If the client does not have a logo, a logo will be designed and included as part of the free build at no extra charge. Logo files are provided to the client and remain the client's property. Logos are not stored on our systems beyond what is needed to deliver the build.
6. Ownership
The website is provided as a hosted service. While the subscription remains active, the website remains live and maintained. If hosting is cancelled or payments fail, the website will be taken offline.
The client retains ownership of:
- Their domain name
- Their logo (whether brought in or designed by us)
- All content provided by the client (text, images, videos)
The website build structure, design system, and hosting infrastructure remain the property of Nimble Dingo.
7. Support and Changes
The hosting fee covers maintaining the website and ensuring it remains live and operational. This includes minor content updates such as text changes, contact detail updates, and small adjustments to existing pages.
The hosting fee does not cover:
- New pages or sections
- Design redesigns or significant layout changes
- New features, integrations, or custom development
- Image, video, or graphic creation beyond the original build
One full revision is included after the client's initial review of the completed build. All revision requests must be submitted in a single consolidated list. Further revisions or new work beyond what is included will be quoted separately and treated as additional services.
8. Payments
Payments are billed monthly via automatic subscription. Failed payments may result in the website being paused until payment is resolved. Continued non-payment may result in permanent suspension and removal of hosting after a reasonable period of attempted contact.
9. Refunds
Hosting fees are non-refundable once a billing period has started. If a build has commenced, any setup work performed is not refundable. Cancellation prevents future billing but does not refund the current period.
10. Limitation of Liability
Nimble Dingo provides hosting and website services on a reasonable-effort basis and aims for high availability, but we are not liable for:
- Loss of revenue, data, or business interruption resulting from website downtime
- Issues caused by third-party services we depend on (hosting providers, domain registrars, AI services, payment processors)
- Force majeure events including outages affecting wider internet infrastructure
Our total liability for any claim is limited to the hosting fees paid by the client in the three months preceding the claim.
11. Acceptable Use
The client agrees not to use the hosted website for:
- Illegal activities
- Distributing malware, spam, or content that infringes intellectual property rights
- Adult content, gambling, or activities prohibited under Australian or UK law (depending on the client's region)
We reserve the right to suspend or terminate hosting if a site is used in breach of these terms.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated to active clients by email at least 14 days before taking effect. Continued use of the service after that period constitutes acceptance.
13. Governing Law
These terms are governed by the laws of Western Australia, Australia. UK clients have the same rights and obligations under these terms unless local law provides additional consumer protections that cannot be contracted out of.
